Auction and sales conditions

  1. By participating in our auction, bidders and buyers accept the following auction terms and conditions.
  2. Individual items are sold in the condition they are in at the time of the auction. No warranty is given for a specific quality, defects, faults, damage, completeness, or special features. Technical data, dimensions, quantity, and years of manufacture are non-binding.
  3. Auctions are generally conducted according to consecutive numbers. In individual cases, we reserve the right to exclude and combine the order and items.
  4. The auctioneer determines the amount of the bid at his discretion for the entire auction or for individual items.
  5. Any bid may be rejected without giving reasons, and the knockdown may be refused or made subject to reservation. The highest bidder is bound by their bid.
  6. The highest bidder will be awarded the knockdown after the auctioneer has repeated their bid three times. If multiple bidders submit the same bid at the same time, the auctioneer will decide. If there is doubt about the knockdown, the auctioneer may re-offer. In all cases, the auctioneer's instructions alone apply.
  7. All prices are in euros. A premium of 5.95 % including VAT will be charged.
  8. Payment of the entire amount due must be made in cash to the auctioneer after the knockdown. If this obligation is not met, the purchased item will be auctioned again. The first buyer will not be permitted to participate. They remain personally liable for any shortfall in proceeds and are not entitled to any surplus proceeds.
  9. The object of purchase is deemed to have been transferred to the buyer upon acceptance of the knockdown, whereby liability and risk of accidental destruction, loss, or damage due to fire, water, storm, theft, and burglary are transferred to the buyer. This also applies, in particular, to accessories.
  10. Buyers are obligated to accept the auctioned items. All auctioned goods must be picked up in full within the specified deadlines. Buyers are responsible for loading and transport. If the pickup date is exceeded, the buyer is liable for any subsequent costs.
  11. All payments are to be made only to the signed auctioneer.
  12. The auctioneer is entitled to collect and sue for purchase money and ancillary services in his own name on behalf of the client.
  13. A bidder who purchases on behalf of a client is jointly and severally liable with the client.
  14. If two or more people submit the same bid at the same time and the invitation to submit another bid is unsuccessful, the auctioneer decides.
  15. If disputes arise regarding the final bid, the item will be auctioned again.
  16. If foreclosure proceedings are initiated or threatened against the buyer, the auctioneer may demand payment at any time before the due date.
  17. The above conditions also apply to all items offered for sale that are sold privately.
  18. t auctions with cash or check payments, children may only remove the purchased items before payment of the purchase price with the auctioneer's permission.
  19. Invoices issued during or immediately after the auction require further review, so subsequent corrections are permitted.
  20. No liability is assumed for accidents during viewing, auction, or collection. Operating equipment is strictly prohibited.
  21. The buyer is liable for all direct and indirect damages and consequences caused during dismantling or removal.
  22. All visitors to the auction are liable for any damage caused, regardless of the type. Entry to rooms and areas at the auction and viewing venue is at your own risk.
  23. The purchase price is due immediately upon conclusion of the contract. The goods remain the property of the auctioneer until full payment (in the case of payment by check or bill of exchange, until redemption) of all claims the auctioneer may have against the buyer, regardless of the legal basis. In the event of a breach of contract or default by the buyer, the goods may be demanded until full payment is made. As security, the buyer hereby assigns to the auctioneer in advance all claims against third parties arising from any resale, including after processing or relocation of the goods, including all security and ancillary rights, up to the amount of the auctioneer's invoice value, including interest, without the need for a special agreement in each individual case. Interest is due immediately after the payment date without further notice.
  24. When purchasing a vehicle, the buyer must check whether it has been properly deregistered with the vehicle registration office. If this is not the case, the buyer must deregister the vehicle immediately. Any damage or financial loss, regardless of the incidents resulting from the use of the purchased vehicle, is the responsibility of the buyer.
  25. Purchased items that are permanently attached to land or buildings must be removed in such a way that no damage occurs at the dismantling site or to other equipment. This also applies to the transport or improper movement of machinery and equipment on paved areas and roads. Failure to comply with these provisions shall entail the cost of repairs and incidental costs.
  26. The place of performance and jurisdiction for all deliveries and payments is Koblenz.
  27. Should any of the above provisions be invalid in whole or in part, this shall not affect the validity of the remaining provisions or the contract. The invalid provision shall be replaced by one that most closely approximates the intended economic purpose and the intention of the parties.
  28. In the case of a conditional acceptance, the purchase price is due immediately. Should the conditional acceptance be revoked by the auctioneer, the purchase price will be immediately returned to the bidder. Otherwise, paragraph 23 of the Conditions of Auction and Sale shall apply in this case.
